Cloaked ships with out a cloaking device? |

Hello everyone:
I've had a problem recently with enemy ships bypassing my guardian ships at warp points. At the end of one turn I'll have no enemy ships in my system with 10 ships with basic sensors at each warp point, the next turn there is an enemy ship in my system without initiating combat with my ships at the warp point. I can see the ship with basic sensors and I can select and attack it with my ships, but when I attack the enemy ship dose not have a cloaking device or stealth armor.
How are these ships getting past my guard ships without them attacking when they come through the warp point? I don’t have a treaty with this empire to allow his ships access to my space. Am I missing something?

If it's a Balance Mod game, the warp point could have a sector obscuration effect.

Is that Warp Point coloured the normal purple or is it some other colour?
