Description
The game enforces treaty elements but it should be possible to break certain elements. Just because a treaty exists, that does not keep people from violating it. If a violation occurs, the other empire should get angry. For example, if a treaty keeps an empire from destorying stars, but the empire chooses too, then they should be able to.

Not the worst thing
I think it's ok since there wouldn't be much incentive to stop from using it to exploit the AI (or perhaps naive players) otherwise. This way you at least have to break the treaty first... which otherwise might not happen...

It would make sense that any element of the treaty could be abandoned at any time by either party, with the condition that the other party would be immediately notified. So an empire could build a star destroying ship, with the clause that the other empire in the treaty would be immediately notified. This lets all parties have some freedom, while maintaining a reasonable amount of security in making such restrictive treaties.




Not a bug
Not a bug really as the game works as intended. That said it would be a nice feature especially for devious players both AI and Human I can see Maran's Vertaxi doing this sort of thing and putting it down to pirates or something.
